Resolution No. R-2021-2765 – A Resolution in Support of Proclamation of Advanced Closed Fire Season in Southwest Utah

WHEREAS, the Utah State Forester, in accordance with Utah Code Section 65A-8-211(1), has advanced the closed fire season in Southwest Utah to begin on May 1, 2021 instead of June 1, 2021;

WHEREAS, Washington County (“County”) recognizes the fire threat that naturally-caused weather conditions pose to people and property within the County;

WHEREAS, wildfire danger is unseasonably high due to warmer temperatures, drier than normal weather and abnormally dry fuel conditions in Southwest Utah, including in the County;

WHEREAS, wildlands threatened by wildfire are critical to sustain public safety, health and economic well-being;

WHEREAS, an advancement of the closed fire season would reduce open burning on unincorporated state and private land; and

WHEREAS, it is in the best interests of the residents of Washington County that the closed fire season be extended until the fire risk lessens.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY COMMISSION OF WASHINGTON COUNTY, UTAH, that Washington County supports the advancement of the closed fire season as described in the attached Utah State Forester Proclamation.

VOTED UPON AND PASSED BY THE WASHINGTON COUNTY COMMISSION AT A REGULAR MEETING OF THE WASHINGTON COUNTY COMMISSION HELD ON THE 4th DAY OF MAY, 2021.

New Colorado River Authority Act enacted to protect water interests in Utah.

WASHINGTON COUNTY, Utah (March 10, 2021) — Utah’s 2021 Legislature passed the Colorado River Authority of Utah Act addressing management of the state’s interests in the Colorado River system.

A new six member council from across Utah will include a member representing Washington County’s Conservancy District.

Washington County Commissioners applaud efforts to preserve and protect water interests which are critical to southern Utah’s water needs in the near future.

Protecting the Colorado River

County Leaders Laud Passage of Historic Legislation

Washington County Commissioners Gil Almquist, Victor Iverson, and Dean Cox applaud the Utah Legislature’s passing of H.B. 297: Colorado River Amendments. This bill, sponsored by Speaker of the House Brad Wilson and Senate President Stuart Adams , passed the Utah House of Representatives with a vote of 61 to 12 and the Utah Senate with a vote of 24 to 3. The legislation now heads to the governor’s office for final approval.

“The Colorado River is one of our most valuable resources,” Commission Chair Gil Almquist said. “Utah consistently ranks as one of the driest states in the nation. We need water to support our economy and livelihoods. We have water rights to the Colorado River that have never been used and it’s important we protect those rights. We appreciate the legislature’s passage of this worthwhile bill.”

House Bill 297 will enact the Colorado River Authority of Utah. The Authority will be made up of six members from different geographical regions in Utah, including the Virgin River watershed area of Washington and Kane counties.

Commissioner Dean Cox commented, “Southern Utah voices are critical when discussing the future of Utah’s water. We are pleased the legislature recognized Washington County in this provision.”

The mission of the authority is to protect, conserve, use and develop Utah’s Colorado River appropriation. The authority will also be tasked with studying issues impacting the Colorado River system and developing management plans. Similar task forces have been created in other Colorado River Basin states.

“The Colorado River is one of the most important water sources for seven western states and part of Mexico,” said Commissioner Victor Iverson. “Wise stewardship and deliberation is critical as we seek to balance the demands on this important and limited resource. Our approach must protect Utah’s present and future water needs, while respecting other river users. This bill is a great step toward accomplishing this crucial goal.”

Northern Corridor Right-of-Way and Mojave Desert Tortoise

We are pleased to announce a decision by the US Department of Interior to grant the Northern Corridor Right-of-Way and a Mojave Desert Tortoise incidental take permit that protects private property rights in Washington County.

We thank all those who have worked hard for many years to get us to this point. We thank those at all levels of government who have worked to make this decision balanced and effective. We also thank the public for their input.

We would like to highlight a few of the notable advantages as a result of these decisions. For example, the new transportation route will enable more efficient travel and reduce congestion along I-15, St. George Blvd, Red Hills Parkway and Skyline Drive. Also, the Red Cliffs Desert Reserve will be enlarged by 7,000 acres which increases protected habitat for the Mojave Desert tortoise. The Northern Corridor will also accommodate a more rapid response in the event of damaging wildland fires within the sensitive habitat and by preventing traffic congestion it will prevent air pollution.

We appreciate the negotiations that have resulted in meeting multiple goals including preserving a healthy Desert Tortoise population.
