NOTICE is given to all interested persons that on the 3rd day of May, 2016, the Washington County Commission adopted a resolution proposing the creation of the Diamond Valley Fire Special Service District (“the district”). The boundary of the proposed district encompasses all privately owned real property in the Diamond Valley Area. A map of the proposed district is available on the Washington County website (click here to download map), or at the Washington County Commission Office, 111 East Tabernacle Street, St. George, Utah.
Under the resolution, the district would provide fire protection services.
A public hearing shall be held on the 15th day of June, 2016, at 7:00 p.m. at the Diamond Valley Fire Station, located at 1651 West Diamond Valley Drive, St. George, UT 84770. The Washington County Commission will hear all interested persons and entity representatives desiring to be heard, and will give full consideration to all protests presented. If special accommodations are required, please contact Nicholle Felshaw (435-301-7000) with reasonable advance notice.
Additionally, any interested person may protest the creation of the district in written form filed with the Washington County, Utah Clerk-Auditor, whose physical and mailing address is 111 East Tabernacle Street, Saint George, Utah 84770. All written protests must be filed by 4:55 p.m. on August 14, 2016. All withdrawals of a written protest or cancellations of withdrawals must also be filed in the same manner and by 4:55 p.m. on August 14, 2016.
If adopted, taxes upon all taxable property within the district will continue to be subject to annual levying as has previously been approved and levied by the Southwestern SSD. Fees and/or charges are subject to imposition to pay for all or part of the services to be provided by the district.
Any written protest made on behalf of any corporate-owned property sited within the proposed district shall be signed by the president, vice-president, or any duly authorized agent of the corporation. Any reasonable proof of a corporate officer’s or agent’s status with the corporation may be requested at the discretion of the County Clerk-Auditor. Where property sited within the proposed district is legally owned by more than one person and/or entity, all owners holding legal title to the property must join in the signing of the protest in order for it to be considered in the calculation stated below.
The Washington County Commission will abandon its efforts to create the Diamond Valley Fire Special Service District if, by the filing deadline stated above, written protests are submitted by: (1) registered voters residing within the Southwestern SSD equal in number to at least 25% of the number of votes cast for the office of President of the United States at the most recent election, or (2) owners of private real property within the proposed Diamond Valley Fire SSD that covers at least 25% of the total private land area within the proposed Diamond Valley Fire SSD and is equal in value to at least 15% of the value of all private real property within the proposed Diamond Valley Fire SSD.
Subsequent to the closing of the sixty day protest period, the Washington County Commission shall adopt a resolution either creating the proposed district or abandoning the creation of the district.
